Terms Of Service

*Please read this agreement carefully, as it contains important information regarding your legal rights and remedies.

Effective Date: June 25, 2025

1. Acceptance of Terms

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between BuiltFast LLC, a Kentucky limited liability company located at 6844 Bardstown Rd Unit #2660, Louisville, KY 40291 ("BuiltFast", "Company", "we", "us", or "our") and you, the customer ("Customer", "you", or "your").

By accessing our website, creating an account, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you must not use our services.

2. Eligibility and Account Requirements

2.1 Age Requirement

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement.

2.2 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

2.3 Account Security

You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

3. Services

3.1 Hosting Services

BuiltFast provides the following web hosting services:

  • Shared web hosting
  • Virtual Private Server (VPS) hosting
  • Managed WordPress hosting

3.2 Additional Services

We also offer:

  • Domain name registration, renewal, and transfer services through our registrar partner OpusDNS GmbH
  • SSL certificate services
  • Daily backups for disaster recovery purposes

3.3 Service Availability

We will use commercially reasonable efforts to maintain 99.99% uptime for our hosting services, subject to the Service Level Agreement outlined in Section 11.

4. Billing and Payment

4.1 Billing Cycles

Our services are billed in advance according to the following billing cycles:

  • 1 month
  • 12 months
  • 24 months
  • 36 months

4.2 Payment Methods

We accept payment by credit card. Payment is due in full at the time of service activation and each renewal period thereafter.

4.3 Automatic Renewal

Services will automatically renew for the same term length unless you cancel before the renewal date. You may disable automatic renewal in your account control panel at any time. We will attempt to charge your payment method on file approximately 7 days before your service expiration date.

4.4 Failed Payments

If payment fails, we may suspend your services until payment is received. We do not charge late fees, but your services may be terminated if payment remains outstanding for more than 30 days.

4.5 Taxes

You are responsible for all applicable taxes, duties, and governmental charges related to your use of our services.

5. Refund Policy

5.1 Money-Back Guarantee

We offer a 30-day money-back guarantee for new hosting accounts. If you cancel within 30 days of your initial signup, you will receive a full refund of hosting fees paid. This guarantee applies only to hosting services and does not include domain registrations, SSL certificates, or other add-on services.

5.2 No Refunds After 30 Days

After the initial 30-day period, all fees are non-refundable. If you cancel your service after 30 days, you will not receive a refund for any remaining unused portion of your billing period.

5.3 Domain Refunds

Domain registration fees are non-refundable, as domains are registered with third-party registrars upon purchase.

6. Acceptable Use Policy

6.1 Prohibited Uses

You may not use our services for any illegal activities or in any way that violates these Terms. Prohibited uses include, but are not limited to:

  • Sending spam or unsolicited bulk email
  • Hosting or distributing malware, viruses, or malicious code
  • Engaging in phishing, fraud, or identity theft
  • Hosting illegal content including child pornography
  • Infringing on intellectual property rights
  • Engaging in harassment, threats, or hate speech
  • Using excessive server resources that impact other customers
  • Running cryptocurrency mining operations
  • Hosting content that promotes violence or terrorism
  • Operating illegal gambling or pharmaceutical operations

6.2 Resource Usage

While we provide generous resource allocations, you may not use our services in a way that unreasonably impacts server performance or other customers' websites. We monitor resource usage and reserve the right to take action if your usage is excessive.

6.3 Compliance with Laws

You are responsible for ensuring your use of our services complies with all applicable local, state, federal, and international laws and regulations.

7. Data and Backups

7.1 Your Responsibility

You are solely responsible for maintaining backups of your data, files, databases, and other content. While we provide daily backups for disaster recovery purposes, these backups are not guaranteed and are not a substitute for your own backup practices.

7.2 Our Backup Services

We perform daily backups of server data for disaster recovery purposes only. These backups are maintained at our sole discretion and may not be available for individual file restoration. Backup restoration services, if available, may be subject to additional fees.

7.3 Data Loss

We are not liable for any data loss, corruption, or destruction. You acknowledge that computer and server systems can fail, and you accept the risk of potential data loss.

8. Intellectual Property

8.1 Your Content

You retain all rights to content, data, and materials you upload to our services ("Your Content"). By using our services, you grant us a limited, non-exclusive license to host, store, and transmit Your Content solely for the purpose of providing our services.

8.2 Our Property

All software, hardware, systems, and technology used to provide our services remain our exclusive property or the property of our licensors. You acquire no rights to our infrastructure, software, or proprietary systems.

8.3 Compliance

You represent and warrant that Your Content does not infringe on any third-party intellectual property rights and that you have all necessary rights to use and distribute Your Content.

9. Privacy and Data Protection

9.1 Privacy Policy

Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9.2 GDPR and CCPA Compliance

We comply with applicable data protection laws, including the General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA). European and California residents have additional rights regarding their personal data as outlined in our Privacy Policy.

9.3 Data Processing

By using our services, you consent to the processing of your data as described in our Privacy Policy and as necessary to provide our services.

10. Support

10.1 Support Channels

We provide customer support through:

  • Email support: Available 24/7
  • Live chat support: Available 24/7
  • Phone support: Available Monday through Friday, 9:00 AM to 7:00 PM Eastern Time

10.2 Support Scope

Our support covers issues related to our hosting platform, server management, and basic troubleshooting. We do not provide support for custom programming, third-party applications, or website content issues.

11. Service Level Agreement (SLA)

11.1 Uptime Guarantee

We guarantee 99.99% monthly uptime for our hosting services, calculated on a monthly basis.

11.2 Service Level Credits

If we fail to meet our uptime guarantee, you may be eligible for service credits according to the following schedule:

  • Monthly uptime below 99.99% but above 99.9%: 5% credit of monthly hosting fees
  • Monthly uptime below 99.9% but above 99.0%: 15% credit of monthly hosting fees
  • Monthly uptime below 99.0%: 25% credit of monthly hosting fees

11.3 Credit Terms

  • Credits apply only to hosting fees, not domains, SSL certificates, or other add-on services
  • You must request credits within 30 days of the incident
  • Credits are applied as account credit for future services, not cash refunds
  • Scheduled maintenance does not count against uptime calculations
  • Maximum credit per month is capped at 25% of monthly hosting fees
  • Credits are your sole remedy for uptime failures

11.4 Exclusions

The uptime guarantee does not apply to:

  • Scheduled maintenance (with advance notice)
  • Emergency maintenance for security or stability
  • Issues caused by your actions or content
  • Third-party service failures beyond our control
  • Force majeure events

12. Suspension and Termination

12.1 Suspension

We may suspend your services immediately without notice if:

  • Your account is being used in violation of these Terms
  • Your usage is causing performance issues for other customers
  • Your payment is overdue
  • We receive a legal order requiring suspension
  • We reasonably believe suspension is necessary to protect our network or other customers

12.2 Termination by You

You may terminate your services at any time through your account control panel or by contacting support. Termination will be effective at the end of your current billing period unless you request immediate termination.

12.3 Termination by Us

We may terminate your services for material breach of these Terms, with 10 days' written notice and opportunity to cure. We may terminate immediately for:

  • Repeated violations of these Terms
  • Illegal activity
  • Non-payment after 30 days
  • Abuse or threats directed at our staff

12.4 Effect of Termination

Upon termination, your access to services will cease, and your data may be deleted. You are responsible for retrieving your data before termination. We are not obligated to provide data retrieval assistance after termination.

13. Domain Name Services

13.1 Domain Registration

Domain registration services are provided through our registrar partner, OpusDNS GmbH. Domain registrations are subject to the terms and policies of the applicable domain registry and our registrar partner.

13.2 Domain Ownership

You are the owner of any domains registered through our services, subject to the domain registry's terms and conditions.

13.3 Domain Renewals

Domain renewals are your responsibility. We will attempt to auto-renew domains when possible, but you are ultimately responsible for ensuring your domains remain current.

13.4 Domain Transfers

We will cooperate with legitimate domain transfer requests. Domain transfers may be subject to registrar transfer policies and fees.

14. Limitation of Liability

14.1 Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED SERVICE.

14.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

14.3 Exclusion of Consequential Damages

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE THEORY OF LIABILITY.

14.4 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you in whole or in part.

15. Indemnification

You agree to defend, indemnify, and hold harmless BuiltFast, its officers, directors, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Your Content or activities

16. Dispute Resolution

16.1 Binding Arbitration

Any dispute, claim, or controversy arising from or relating to these Terms or our services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

16.2 Arbitration Rules

Arbitration will be conducted under the rules of the American Arbitration Association (AAA). The arbitration will take place in Louisville, Kentucky, or at another location mutually agreed upon.

16.3 Class Action Waiver

You agree that any arbitration shall be limited to the dispute between you and BuiltFast individually. You may not bring a claim as a class action, collective action, or representative action.

16.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to us within 30 days of accepting these Terms. Opt-out notices should be sent to: legal@builtfast.com with the subject line "Arbitration Opt-Out."

17. General Provisions

17.1 Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17.3 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BuiltFast regarding our services.

17.4 Modifications

We may modify these Terms at any time by posting updated terms on our website. Material changes will be effective 30 days after posting, and your continued use of our services constitutes acceptance of the modified Terms.

17.5 Assignment

You may not assign these Terms without our written consent. We may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

17.6 Force Majeure

We shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.

17.7 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
